(GTC) of the Greenland Rolling Academy


1. General
1.1 Subject of these GTC

The fact that the General Terms and Conditions (GTC), which are an integral part of every contract, are made clear from the outset also contributes to the success of an event.

The following general terms and conditions regulate the business relationship between Greenland Rolling Academy and its customers* (hereinafter "participants").

For the sake of simplicity, a course, coaching or event is referred to as an event in the following text. Greenland Rolling Academy is the company name. Responsible is Britta Laube.


2. Registrations
2.1 Registration Process, Booking Confirmation, Payment

Registration for our events takes place via the contact form on our website or via an e-mail to info@greenland-rolling-academy.de and offers the Greenland Rolling Academy the conclusion of a binding contract. If a person registers several participants, they are also responsible for their contractual obligations.

The contract is concluded with the booking confirmation sent by us. With the booking confirmation, the request for payment is sent with a payment period of 14 days.


2.2 Fully Booked Programs

The Greenland Rolling Academy endeavors to mark fully booked events as "fully booked" on its website as quickly as possible. However, should it happen that an event is already fully booked at the time of registration, there is no right to participate.



3. Greenland Rolling Academy services

The websitewww.greenland-rolling-academy.deis a platform for booking courses in the Greenland-inspired paddle and roller style. The service to be provided refers to the description of the booked event. However, the Greenland Rolling Academy reserves the right to change the program (and thus the booked service) in individual cases, especially if the situation on site and the safety of the participants and the event manager so require. This can be, for example, weather-related changes to planned times in the water (excessive wind, thunderstorms, etc.) or a flexible program that is based on the given conditions and/or the special needs of the participants. Force majeure, legal provisions, illnesses, etc. can necessitate changes to the service offered at very short notice. In principle, the Greenland Rolling Academy strives to deliver the best possible services within the framework of the advertised event - but the safety of our participants and employees always comes first. In principle, there is no right to a refund for services not used.


The Greenland Rolling Academy offers various events at home and abroad. Our Greenland roller courses are all about imparting various teaching content on the subject of kayak rollers. So it makes sense that most of our events take place on the water. In addition, we also offer other events (e.g. yoga for paddlers, etc.) on land, which are also clearly related to sea kayaking. This results from the respective event description.

Depending on the advertisement, a Greenland Rolling Academy event can last for one or more days, but is always limited to our services on or on the water or at the event location during the event days and course times advertised in the program.


The Greenland Rolling Academy is not responsible for the accommodation of the participants. The participant is responsible for arranging their own accommodation at the venue. The Greenland Rolling Academy is not responsible for the organization and execution of the journey.



4. Security and Disclaimer

4.1 Security

The participant assures that he/she has a normal physical constitution and sufficient swimming skills and only takes part in the event in a symptom-free state of health.

The responsible event manager has the full authority to change or cancel a program at any time for safety reasons (e.g. in the event of thunderstorms; see also Section 3).

Should a participant nevertheless decide to go out on the water alone or with other participants without an event manager or their representative, this will be done as a private activity for which Greenland Rolling Academy accepts no responsibility.


4.2 Disclaimer: Participate at your own risk

The Greenland Rolling Academy is liable within the scope of the duty of care for the conscientious preparation and provision of the booked services. The event manager and his representative are authorized to give instructions. The participants undertake to follow the instructions of the event manager. Any damage resulting from non-compliance with an instruction from the event management or its representative is self-inflicted.


The liability of the Greenland Rolling Academy for property damage and personal injury is excluded (limitation: see Section 4.7). Participation in all courses, events and additional programs is at your own risk.


The storage of private property in our vehicles and tents or in rooms rented from us is always at your own risk.


4.2.1 Waiver

Like most sports, rolling sea kayaks, sea kayaking and performing yoga asanas involves certain risks that cannot be completely ruled out, even with conscientious preparation and professional supervision. The participant assures in writing in advance in a form to be filled out that he/she has a normal physical constitution and sufficient swimming skills and that he/she will only take part in the event in a symptom-free state of health.


4.3 Extended disclaimer: Private activities outside of the event program

The Greenland Rolling Academy is solely responsible for the official activities offered in the event program or additionally on site. All activities offered by the Greenland Rolling Academy and its employees, which are either included in the event program or offered as an additional activity to the participants, are considered official activities. The Greenland Rolling Academy assumes no liability for private activities that are carried out, organized and carried out by the participants independently or in a group in addition to the offered event.

This disclaimer applies in particular, but not exclusively, to:

  • Swimming, private paddling or practice and private activities on the water, before, after or outside the Greenland Rolling Academy-led event, including during the lunch break;
  • Private transport to or from the water, by car, bike, public transport or on foot;
  • All private activities (on land and water) before and after the event, managed by the Greenland Rolling Academy.


4.4 Damage to Participant Materials

You use your own material at your own risk. The Greenland Rolling Academy is also not responsible for theft or loss of private property that is lost before, during or after the event managed by the Greenland Rolling Academy, even if the property was in Greenland Rolling Academy vehicles.

Likewise, the Greenland Rolling Academy is not responsible for damage to or loss of personal material (kayaks, paddles, equipment, luggage, etc.) that occur before, during or after our program or during transport to the place of action or to the water. In particular, any liability in connection with damage to mobile phones, cameras, car keys and other electronics taken on the water is rejected.


4.5 Damage Greenland Rolling Academy material

The Greenland Rolling Academy will provide you with high-quality kayaks and paddles on request (and under the conditions listed in the respective advertisement or under Section 6). We assume that participants will treat our input material with reasonable care. Of course, minor damage such as scratches and scrapes occur when boats and material are used. That's okay and, in fact, even unavoidable. Therefore minor damage (e.g. gel coat repairs of up to 1 hour working time) are always at our expense.


If a participant handles the material provided to you improperly or negligently (e.g. landing with force on a pebble beach or a concrete ramp, landing with the skeg extended, “paddle bridge” when boarding, etc.) or major damage (holes, cracks , major gel coat damage, broken paddles, damaged skegs including cable pull etc.), it is up to the participant to either repair them professionally themselves, to pay for the repairs or to make a payment for a new purchase.


4.6 Damage to someone else's property

The Greenland Rolling Academy disclaims any liability for damage to third-party property caused by a participant before, during or after one of our events. This includes damage to the material of other participants or, for example, to boats, harbor facilities, campsite installations, jetties or parked cars (etc.) lying in the harbour.


4.7 Restriction

The limitation of liability formulated in Section 4 does not apply to damage resulting from injury to life, limb or health that is based on an intentional or negligent breach of duty by the Greenland Rolling Academy, a legal representative or a vicarious agent of the Greenland Rolling Academy.


5. Cancellations and Program Changes

5.1 Weather, Natural Disasters, Crises and Force Majeure

Force majeure, legal provisions, illnesses, etc. can necessitate changes to the service offered at very short notice.

If, due to storms, political unrest and crisis situations, floods, nuclear accidents, natural disasters or other situations, there are fears in advance that the safe implementation of a planned event cannot be guaranteed, the Greenland Rolling Academy is entitled to cancel it at any time. In this case, you will not incur any cancellation costs. Payments already made will be refunded in full.


If the weather deteriorates or other events occur during an ongoing event or an event lasting several days that endanger the safe further implementation (or partial implementation), the Greenland Rolling Academy is entitled to make changes to the program at any time without the participants being entitled to any claims for reimbursement can be asserted.


5.2 Withdrawal of participants / cancellation costs

The participants can withdraw from the contract at any time before the start of the event by means of a written declaration. Your withdrawal is only effective with written confirmation from Greenland Rolling Academy. In addition to an e-mail, it is advisable to give us a short telephone call (+49 (0)172 – 79 47 445).

As compensation for the preparations and the administrative effort, we can demand compensation:


up to 60 days before the start of the event 20%

up to 14 days before the start of the event 70%

from 7 days before the start of the event 100%


If the event is not attended, the full price of the event will be charged.

If you fail to appear, arrive late or leave the event early, there is no entitlement to a price reduction or reimbursement of costs. The same applies if a participant misses parts of a multi-day program because, for example, they become ill during an event or temporarily feel unwell.

Substitute:

You can withdraw from the contract in writing up to three days before the start of the event if a replacement person is provided at the same time. We will then charge a processing fee of EUR 25 and the resulting additional costs, provided the replacement person meets the event requirements and the Greenland Rolling Academy does not object to the change of person.


5.3 Resignation of the Greenland Rolling Academy:

The Greenland Rolling Academy can withdraw from the contract up to 7 days before the start of the event if the minimum number of participants has not been reached, but must inform the participants immediately. Greenland Rolling Academy undertakes to promptly reimburse all payments already made, but does not have to pay any further compensation for preparations already made, loss of earnings or bookings/cancellations. The Greenland Rolling Academy can withdraw from a contract without notice before or during an event if the participant persistently disrupts the preparation or implementation of an event despite warning, endangers other participants or companions, behaves in breach of contract or does not meet the requirements due to a Misjudgment of his performance is not up to it. During an event, the withdrawal from the contract without notice can also be verbally pronounced by an event manager or his representative. The Greenland Rolling Academy retains the right to the full event price; the Greenland Rolling Academy may have to reimburse any expenses actually saved.


6. Prices

The prices and conditions communicated in the respective event advertisement apply.


6.1 Rental prices for kayaks and material

To take part in our events, the participant can rent a kayak if ordered in advance. Unless otherwise specified in the event advertisement, the following prices apply:


  • Kayak: 20 euros / day
  • Paddle: 5 euros / day
  • Tuilik: 10 euros / day


7. Greenland Rolling Academy business liability insurance

The Greenland Rolling Academy has a business liability insurance.


8. Final Provisions

8.1 Severability Clause

Should a provision of these General Terms and Conditions be or become invalid, this will not affect the validity of the remainder. The ineffective provision will be replaced by an effective provision that comes as close as possible to the purpose of the ineffective provision. The same applies to any gaps.


8.2 Jurisdiction

Place of jurisdiction for both contractual partners is Flensburg.
